Terms and Conditions

This section describes the terms and conditions that govern the use (in any form) of the TheHearth.org portal, as well as the relationship between the portal and/or its owners or administrators with the people who use it, according to the role they assume (in accordance with the definitions adopted here). This text constitutes, in its entirety, the sole contract regarding the issues discussed here, but with different scopes depending on the actions of the parties involved.

For the best understanding of these terms and conditions, we establish the following definitions, which are valid throughout the text even in its plural version (when applicable):

  1. TheHearth.org: May refer interchangeably, depending on the context and obligations under the law, to:
    1. The web page itself or URL (Uniform Resource Locator, for its acronym in English: Uniform Resource Locator ) TheHearth.org, also referred to as “the portal” or “this website”.
    2. The trademark(s) associated with TheHearth.org or any other related trademark(s).
    3. All or some of the members, administrators or owners of TheHearth.org.
  2. USER: Natural or legal person who accesses the URL TheHearth.org and completes and sends the data collection form(s) to request information or contract the services

TheHearth.org website is hosted on servers owned by (or used by) BanaHosting in the United States of America and/or any of its related or associated companies, services or brands, and is therefore subject to its terms and conditions of use without having any decision-making power or interference in them, which is expressly accepted by USERS and VISITORS, who in turn declare that they are aware of and accept such terms and conditions of use of said provider when relating in any way to the portal, including when accessing or browsing it. Likewise, USERS and VISITORS acknowledge and accept that TheHearth.org has no link with said platform or company, nor any interference in its corporate decisions, policies or conditions of use of its services, beyond the web hosting service contract.

The programming of the portal has been carried out on the WordPress platform, property of the company Automattic Inc., therefore TheHearth.org accepts the policies and conditions of use of said platform and establishes as a condition of use or navigation through the portal that such situation is accepted by the USERS and VISITORS, who also admit that TheHearth.org has no link with said platform nor any interference in its policies or conditions of use, beyond its use for the development of this website.

III.- CONCEPT AND CONTENT OF THE PORTAL:

TheHearth.org is a website dedicated to providing information and support about Alzheimer's. Extensive resources and guidance on Alzheimer's disease. We provide you with the support and information you need every step of the way.

IV.- APPLICABLE LEGISLATION AND JURISDICTION:

These terms and conditions, as well as the entire TheHearth.org portal and the relations between said portal, its administrators and/or owners with the USERS and VISITORS, are governed, interpreted and applied in accordance with the laws of the United States; and are also subject to the jurisdiction of its courts that are competent based on the subject matter, amount or territory.

The above does not exclude the possibility of establishing, through particular agreements, special addresses, specific jurisdictions (including alternative dispute resolution mechanisms) or the application of other legislation within the framework of what is admitted by Private International Law.

V.- TRADEMARKS AND COPYRIGHT:

All content on TheHearth.org, including text, code, software, names, images, illustrations, audio, video, designs, brands, trade names, own links, and in general any multimedia or other content, are the intellectual and/or industrial property of TheHearth.org, and are protected by Venezuelan law and, in many cases, internationally; except for those that are the property of third parties and to which reference is made.

All rights of use and exploitation (whether commercial or not) are the sole and exclusive property of TheHearth.org, so USERS and VISITORS may not use, download, copy, reproduce or refer to any element of the portal without prior written authorization from TheHearth.org, and in the following cases and under the following conditions:

  1. It must be for exclusively personal and non-commercial use, that is: there is no intention to obtain any profit or benefit in any way.
  2. In any case and under any circumstances, reference must be made to the authorship or ownership of TheHearth.org, indicating the respective link.
  3. No modifications must be made to the material or content of the portal.
  4. There should be no impression or appearance of linking the persons, content, brands, products or services of TheHearth.org with other persons, content, brands, products or services of third parties.
  5. The names of persons associated with TheHearth.org or the contents and brands of said portal must not be used in activities that are unlawful under the United States, or any other State, Region or jurisdiction in general, or in activities that violate other agreements or contracts entered into by third parties.
  6. The content of TheHearth.org must not be stored in databases or on any other physical, computer or electronic medium.

VI.- REGARDING THE PERFORMANCE OF THE VISITOR AND THE USER AND THEIR INTERACTION WITH THE WEBSITE:

The relationship between TheHearth.org and each USER is developed without implying any type of commercial, associative or much less labor agreement (unless it is expressly established by special agreement), since the activities carried out by TheHearth.org or the interactions between said portal and the USER will be understood as developing (and as a consequence) the services provided by TheHearth.org.   3. The portal uses various mechanisms for its monetization, including advertising systems, so VISITORS and USERS recognize and accept this situation, and expressly agree that under no circumstances will they consider the advertising displayed in the environment of TheHearth.org to be invasive. They also accept that advertising material may occasionally be sent to them from TheHearth.org to the email addresses provided.

  4. Any errors on our website.

  7. Errors in our website or its links.
  8. Delays in operation or in the transmission of data to or from our website.
  9. Computer viruses or line failures.

VIII.- GENERAL PRIVACY AND DATA PROCESSING POLICY:

VIII.1.- General aspects regarding request and use of information:

Whenever you are asked to fill out any type of form with personal information, we ensure that it is only used solely and exclusively in accordance with these terms and conditions, and for specific purposes.

VIII.2.- About the comment forms:

In the fields intended for comments on the website, which are free to write, the data that the USER or VISITOR enters at his or her own will and discretion is collected, as well as the visitor's IP address and the browser's user agent string to help detect SPAM or junk mail. In addition, it is possible that an anonymous string is generated from the email address (called a hash) that can be provided to the Gravatar service to check if it is being used. After approval of your comment, your profile picture is visible to the public in the context of your comment.

VIII.3.- Regarding the upload of multimedia content:

In certain cases, the portal may allow the uploading of images or multimedia media, in which case the USER must avoid uploading files with included location data (EXIF GPS), since visitors to the website can download such files and extract any associated location data.

VIII.4.- Embedded content from other websites:

The entire portal includes embedded content from other websites (videos, images, articles, etc.). VISITORS and USERS understand and accept that this content behaves exactly as if it were the website to which it belongs, with all its implications in terms of data collection, cookies, and its own terms and conditions in general that are beyond the control and responsibility of TheHearth.org.

VIII.5.- Analytics:

TheHearth.org uses the user accounting system called Google Analytics to collect information about the origin of visits to the portal. This system may collect personal information from VISITORS and USERS such as IP address, country of origin, origin of the session, duration, interactions, browser, behavior, personal data about sex and age, search preferences and/or other data collected by Google Analytics in accordance with its terms and conditions of use, which both VISITORS and USERS declare to know and accept.

VIII.6.- Destination of the data (with whom it is shared):

Data collected on TheHearth.org is shared with Google Analytics to perform the functions described above.

The data entered in comments and contact forms will be saved in our email accounts.

The personal information provided will not be transferred, sold, published, distributed or shared without the prior consent of the owner, except in the cases described in this document, for which purpose the respective authorization is understood to be granted upon acceptance of these terms and conditions and/or by the mere fact of providing such data.

Notwithstanding the foregoing, TheHearth.org will comply with information requests made by any administrative or judicial authority.

Comments and their metadata are retained indefinitely. This is so that we can recognize and approve any subsequent comments automatically instead of holding them in a moderation queue.

VIII.8.- Rights of VISITORS and USERS over their data:

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where do we send your data?

Visitor comments may be checked through an automatic spam detection service. Your data is stored on the same server where the website is hosted, currently on Google Cloud Platform, through a secure encrypted tunnel called SSL.

The data collected through the contact form is stored in our email.

How do we protect your data and what measures do we use against data breaches?

We use the SSL encryption system to ensure the highest security when receiving data. You can check its operation from the browser itself, noting the “https” prefix before the domain instead of “http”.

We use protection systems such as a firewall on our website, as well as security plugins for our website, generated using the WordPress platform.

IX.- Cookies Policy:

In simple terms, a cookie is a computer file that the server of a website (such as TheHearth.org) sends to the computer (laptop, tablet, phone) of whoever visits that website, in order to store and retrieve certain information about the browsing.

VISITORS or USERS who choose to leave a comment on the portal may choose to save their name, email address and website in cookies. This is to provide the greatest possible convenience and to avoid such data having to be completed again for a new comment. These cookies will last for one year.
